The November Change
A 2025 federal law redefined hemp more strictly than the 2018 Farm Bill, with limits on THC per container and in intermediate products. Stricter rules take effect in November 2026. Whitney Economics projects, if the rules stay as written, a $28.3 billion reduction in retail revenue, about 225,000 jobs displaced and only about 8.5% of current cannabinoid products remaining for sale. Our hemp law change explainer covers the legal detail.
How to Read These Figures
- The Whitney figures come from a self reported operator survey from June and July 2026, projected nationally, and the release is internally inconsistent in places (for example 36% versus 36.3% growth).
- Market size estimates differ by publisher. Our US cannabis market guide uses licensed cannabis sales, which is a different measure.
- Acreage is small compared with major crops, so the market value is driven by processed products, not land area. See hemp farming 101.
What It Means for Consumers
Expect product availability to shift. Non intoxicating products such as CBD may be affected by the same rules, so check current legality in your state before stocking up.
