Hemp law in India is split between a national drug statute and state level rules. The result is confusing, so we have laid out what the law says, where it is flexible and where caution is wise.
The Short Version
| Plant part or product | General position |
|---|---|
| Flowering or fruiting tops (ganja, charas) | Prohibited under the NDPS Act |
| Seeds and leaves (when not with the tops) | Excluded from the “ganja” definition in the Act |
| Bhang (leaf preparations) | Allowed in some states under state rules and licences |
| Industrial hemp for fibre and seed | Possible under state licences (for example Uttarakhand), with low THC limits |
| CBD products | Grey area, depends on source and THC content |
What the NDPS Act Says
- Section 2(iii): defines ganja as the flowering or fruiting tops of the cannabis plant, and excludes seeds and leaves when not accompanied by the tops.
- Section 10: lets state governments permit and regulate cultivation of cannabis for fibre, seed or horticultural purposes.
- Section 14: allows the Central Government to permit cultivation for industrial or scientific purposes, including hemp for fibre and seed.
State Licences
Uttarakhand was among the first states to licence industrial hemp cultivation, with a THC ceiling of 0.3% commonly cited. Other states have run pilots or research permits. Rules, fees and eligibility change, so check the current state notification before planning any cultivation.
What Consumers Can Reasonably Do
- Hemp seeds, seed oil and seed flour from reputable, labelled sources are widely sold as food. See our hemp seed oil legality guide.
- Be careful with flower, resin or high strength extracts. These can fall under the prohibited categories.
- For CBD, ask for the lab report and THC level. Our COA guide explains how.

Industrial hemp is generally defined by a THC ceiling of 0.3% or lower in the plant, as used in licences like Uttarakhand’s.
Can I travel with hemp products?
Carrying products across states or borders carries risk. See the travel notes in our global regulation guide.
