Hemp, cannabis and marijuana all refer to the same plant species, Cannabis sativa L. Cannabis is the species name. Hemp is the legal category for plants containing no more than 0.3% THC by dry weight in the US, 0.2% in much of the EU. Marijuana is the informal term for high-THC varieties. Why 0.3%?
The threshold entered US law through the 2018 Farm Bill, but its origin is a 1970s taxonomic paper rather than a pharmacology study. It is a workable administrative line, not a biological one. What it achieves in practice is clear enough: at 0.3% or below, normal consumption does not intoxicate. The EU sets a stricter 0.2% for most member states, and the coming shift toward a total THC calculation in the US is the live regulatory debate to watch.
Same plant, different cultivars
Hemp and marijuana are siblings, not opposites. The analogy that works is apples: Granny Smith and Honeycrisp are the same species bred for different outcomes. Hemp grows tall and fast, historically for fibre and seed and now often for CBD-rich flower. Marijuana cultivars are bushier and denser, selected across decades for cannabinoid potency.
Regulation by region
- United States. Hemp under 0.3% THC is federally legal and shippable across state lines. High-THC cannabis remains federally controlled while many states have legalised it, producing the familiar patchwork. Some states restrict hemp products further than federal law does.
- European Union. Most member states permit hemp under 0.2% THC, with national rules layered on top.
- Canada. Hemp is a regulated agricultural product, and recreational cannabis is legal nationally under a separate framework.
How to verify a product is legal hemp
- Find the batch-specific certificate of analysis, not a generic company one
- Check total THC on that report, not just delta-9 THC
- Confirm the lab is third-party and named, with a contactable address
- Match the batch number on the report to the number on your bottle
- Treat missing test data, unusually low prices and vague potency wording as reasons to walk away
Common misconceptions
“Legal hemp is automatically safe.” Legal means THC-compliant. It says nothing about pesticides, heavy metals or accurate labelling. Those come from testing.
“Hemp and marijuana are different plants.” They are the same species under different breeding and different law.
“Hemp cannot show on a drug test.” Standard tests screen for THC without caring where it came from. Trace THC in full spectrum hemp can accumulate with heavy daily use.
